Effective Date: June 15, 2026
Website: amanarootscounselling.ca

1. Introduction and Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of the website amanarootscounselling.ca (the “Website”), any related services, booking platforms (such as Jane App), communications, and virtual psychotherapy services provided by Amana Roots Counselling, operated by Yasmeen Mohsin, Registered Psychotherapist (Qualifying) (“we,” “us,” “our,” or “Amana Roots Counselling”).

By accessing or using the Website, booking an appointment, participating in any session, or otherwise interacting with us, you agree to be bound by these Terms. If you do not agree, please do not use the Website or our services.

We may update these Terms from time to time. Continued use after changes constitutes acceptance of the revised Terms. We will notify users of material changes via the Website or email where feasible.

2. Services Overview

Amana Roots Counselling provides virtual psychotherapy services to adults across Ontario, Canada. Services are led by Yasmeen Mohsin, a Registered Psychotherapist (Qualifying) with the College of Registered Psychotherapists of Ontario (CRPO). We specialize in trauma-informed, culturally sensitive therapy addressing issues such as trauma, attachment wounds, anxiety, depression, cultural identity, family dynamics, and more.

All sessions are conducted virtually via secure, encrypted, PIPEDA-compliant platforms. We do not provide in-person services.

Important Disclaimers Regarding Services:

  • Our services constitute psychotherapy/counselling and are not a substitute for medical, psychiatric, or emergency care.
  • We do not provide crisis intervention, emergency mental health services, or diagnoses in a medical sense. If you are experiencing a mental health emergency, contact a crisis line (e.g., 988 in Canada), go to the nearest emergency room, or call 911.
  • Therapy outcomes vary and are not guaranteed. Progress depends on individual factors, engagement, and other variables.

3. Eligibility and User Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to use our services. Services are primarily for adults, though we may discuss adolescent support in limited contexts.

When booking or communicating with us, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of any login credentials and for all activities under your account.

4. Booking, Appointments, Cancellations, and Payments

  • Appointments are booked through our third-party platform (e.g., Jane App). You agree to that platform’s terms in addition to these.
  • A free 15-minute consultation may be available to assess fit.
  • Cancellation Policy: Please provide at least 24–48 hours’ notice for cancellations or rescheduling. Late cancellations or no-shows may incur fees (full session rate or as specified at booking).
  • Fees are as published or quoted. We accept various payment methods and offer sliding-scale options where possible. Most private insurance may cover Registered Psychotherapist services — verify with your provider.
  • We reserve the right to refuse or terminate services if we determine it is not a suitable fit or if professional boundaries require it.

5. Client Responsibilities and Conduct

You agree to:

  • Participate honestly and actively in sessions.
  • Respect session times and platform rules.
  • Maintain the confidentiality of any group elements (if applicable, though services are individual).
  • Not record sessions without explicit written consent from us.
  • Provide accurate health and background information as relevant for safe care.

You must not use our services for any unlawful purpose, to harass, or to seek services outside our scope (e.g., legal advice, financial advice).

6. Confidentiality and Privacy

We adhere to applicable Canadian privacy laws (PIPEDA) and CRPO professional standards. Session content is confidential, with exceptions required by law (e.g., imminent risk of harm to self or others, child protection concerns, court orders).

Our separate Privacy Policy (available on the Website or upon request) details how we collect, use, and protect personal information. By using our services, you consent to the practices described therein.

7. Intellectual Property

All content on the Website, including text, graphics, logos, and therapeutic materials (unless otherwise noted), is owned by or licensed to Amana Roots Counselling and protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without prior written permission, except for limited personal, non-commercial use.

8. Disclaimers and No Warranty

The Website and services are provided “as is” without warranties of any kind, express or implied. We do not warrant uninterrupted access, error-free operation, or specific therapeutic results.

We are not responsible for third-party platforms (e.g., video conferencing, booking systems) or any issues arising from them.

Medical/Legal Disclaimer: Nothing on the Website or in sessions constitutes medical advice, diagnosis, or treatment. Always consult qualified healthcare professionals for medical concerns.

9. Limitation of Liability

To the fullest extent permitted by law, Amana Roots Counselling, Yasmeen Mohsin, and our affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website or services, including but not limited to loss of data, profits, or emotional distress.

Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

These limitations do not apply where prohibited by law, including CRPO regulations.

10. Indemnification

You agree to indemnify and hold harmless Amana Roots Counselling, Yasmeen Mohsin, and our representatives from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

  • Your breach of these Terms.

  • Any content you submit or actions you take.

11. Termination

We may terminate or suspend access to services at our discretion, with or without notice, for conduct that violates these Terms or professional standards. You may stop using our services at any time, subject to any outstanding fees or cancellation policies.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.

Any disputes shall be resolved exclusively in the courts of Ontario. You agree to submit to the personal jurisdiction of such courts.

13. Miscellaneous

  • Severability: If any provision is held invalid, the remainder remains in effect.
  • Waiver: Failure to enforce a right does not waive it.

  • Entire Agreement: These Terms (together with the Privacy Policy and any booking agreements) constitute the entire agreement.
  • Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control (e.g., technical failures, natural disasters).
